General Terms and Conditions of Travel Services of Estravel Latvia - Estravel AS branch in Latvia

1. The scope

1.1. The general terms and conditions of travel services apply to travel services which are made accessible by Estravel Latvia - Estravel AS branch in Latvia, uniform reg. No LV40003318736, legal and actual address Str. Elizabetes 63, Riga, LV-1050 (hereinafter referred to Estravel Latvia).
1.2. In addition to these terms and conditions, relations between Estravel Latvia and the Client are governed by special terms and conditions set by the Provider of the Travel Service, and the price list of service charges.
1.3. The general terms and conditions of travel services apply unless special terms and conditions of the travel services provide otherwise. The general terms and conditions and the special terms and conditions of travel services apply unless otherwise provided by the Client’s contract.

2. Meaning of terms used in these Sales Conditions

2.1. The terms and abbreviations have the following meaning:

2.1.1. Estravel Latvia – sales agent who acts as an intermediary and makes the Service Provider’s Travel Services accessible.
2.1.2. Client – legal entity or natural person who places or has placed an order with Estravel Latvia.
2.1.3. Consumer – a natural person who has placed or places an order with Estravel Latvia that is not related to conducting of independent economic or professional activities.
2.1.4. Service Provider – natural person or legal entity who provides Travel Services and with whom the Client enters into the contract to provide the Travel Services.
2.1.5. Travel Service – package tour and single travel service that Estravel Latvia has made accessible.
2.1.6. Order Confirmation – a written document which confirms that contract between the Client and the Service Provider has been made. An Order/Pre-sale Invoice, booking summary, etc. is not an Order Confirmation.
2.1.7. Travel Consultant – the representative of Estravel Latvia that is servicing the Client, offering him/her the Travel Services, related information and processes the purchase of these Travel Services.

3. Sale of Travel Services

3.1. The Travel Consultant introduces the Client with the options of purchasing Travel Services, which depend on changes in demand and offers on the market of Travel Services. Availability of places of Travel Services may change rapidly that is why Estravel Latvia asks the Client to bear in mind that confirming the order and paying the pre-sale invoice as soon as possible makes it more likely that the Client will receive places on the terms and conditions valid at the time the purchase options were introduced.
3.2. Estravel Latvia asks the Client to read the Service Provider’s contract before placing an order and to inform Estravel Latvia on any specific needs related to the Client’s travel requests or of any other circumstances that are important in provision of the Travel Services. Only in this case the Service Provider and Estravel Latvia are able to take into account the Client’s special requests.
3.3. Placement of the order by the Client and payment of the pre-sale invoice becomes a binding Travel Service sale contract after the Service Provider or Estravel Latvia has issued an Order Confirmation.
3.4. The contract has not come into force if the Service Provider has not approved the Client’s order (all places are sold out on the requested date or prices have changed). Estravel Latvia informs the Client about it and, in accordance with the Client’s instructions, either refunds the charge paid by the Client or uses them to execute the amended Client’s request.
3.5. The options to amend or annul the confirmed order are limited. The Travel Consultant introduces the Client with the amendment and annulment conditions of a specific Travel Service before the order is confirmed. The Client sends his/her amendment or annulment request by e-mail. Amending or annulment of the Travel Service usually is charged extra after the Order has been confirmed, unless the Service Provider has stated otherwise.
3.6. If the Client expresses the will to buy the Travel Service on flexible terms and conditions in order to guarantee that the Order Confirmation be amended or annulled with a refund of the travel charge, he/she must inform Estravel Latvia about it at the moment the order is placed.
3.7. The Client is obliged to submit only true data to Estravel Latvia and the Service Provider; he/she is in full responsible for the correctness of provided data, as well as for possible consequential damages caused.
3.8. Estravel Latvia has the right to not execute the Client’s order and annul the Order Confirmation unilaterally without a prior notice if the Client fails to perform the payment obligation or adhering to the general terms and conditions.
3.9. Estravel Latvia makes Order Confirmations and other travel documents accessible to the Client by e-mail or at Estravel Latvia’s office. If requested by the Client, the documents can be sent to the address given by the Client either by courier or by the post office at the Client’s expenses and at his/her responsibility.
3.10. The Client must check the names of the passengers, the dates and other important data, as well the compliance of such data with the entered data and the booking immediately after receipt of the Order Confirmation. It is important to check that the Client’s data in the Order Confirmation matches the data in the Client’s travel document. Any technical errors caused by Estravel Latvia or the Service Provider of which Estravel Latvia has been informed immediately will be eliminated. Later elimination of such errors is either impossible or is the subject to extra charge.
3.11. If any mistakes in the Order Confirmation issued to the Client are the result of the Client’s activity or inactivity, the requested amendments will be made within the possible limits and at the Client’s applicable expenses thereto, including possible purchase of a new Travel Service.
3.12. The Client confirms its irrevocable request to purchase the selected Travel Service and gives its consent to these general terms and conditions, including but not limited to the sale terms and conditions of the Service Provider, by paying the travel charge.

3.12.1. The Client is aware and agrees that he/she enter into a contract with the Service Provider for the provision of the Travel Service.
3.12.2. The Client is also aware and agrees that Estravel Latvia and the Service Provider have the right to process the Client’s personal data pursuant to applicable legislation and terms. The Client gives Estravel Latvia its consent to send his/her data (including but not limited to their personal identification number or payment details) to the Service Provider and/or third parties involved in provision of the Client’s chosen Travel Service by placing the order.

4. The scope and exercising of Consumer’s right of withdrawal

4.1. Possibility of withdrawal from contracts entered into for the provision of Travel Services is limited to since the Travel Services constitute the provision of pre-determined specific services by a certain date or during a certain period of time, or entry into the contract implies booking of certain resources (advanced payment) where finding a new user therefor is complicated upon withdrawal.
4.2. Regardless of whether the Consumer has purchases the Travel Services by the means of communication (e-mail or telephone) or at Estravel Latvia’s office, the Consumer’s right to withdraw from the contract free of charge and without disclosing a reason within 14 days as provided in the Law of Obligations Act (hereinafter the Right of Withdrawal) does not generally apply to Travel Services contracts.
4.3. The Consumer will not be able to exercise the Right of Withdrawal if the Travel Services are provided by a certain date or during a certain period of time, or if entry into the contract implies booking of certain resources (advanced payment) and the contract is entered into for the provision of the following services: passenger transport services; accommodation services; use of a vehicle; catering industry services; travel and luggage insurance; or recreational services.
4.4. Having the Right of Withdrawal, the Consumer is entitled to withdraw from the contract by sending the application to Estravel Latvia’s e-mail address: This email address is being protected from spambots. You need JavaScript enabled to view it.. The period of execution of this right is counted from the day the contract has been concluded.

5. Travel Documents, Visas and Health Requirements

5.1. The Client is responsible for possession of all required travel documents. Estravel Latvia and the Service Provider presume that the Client, incl. a minor, has the travel documents (passport, ID card, visa, vaccination certificate, etc.) required by the country of destination as well as all transit countries.
5.2. Estravel Latvia notifies the Client about the travel document requirements at his/her request, however does not assume responsibility regarding further validity of these requirements, as they may change without a notice.
5.3. Visa and travel document requirements may differ for citizens of various countries. The Travel Consultant provides the primary information about these requirements. The detailed information is available from embassies, the Ministry of Foreign Affairs and the Citizenship and Migration Board.
5.4. The country of destination can decide at its sole discretion whether or not to allow a person to enter a country, even if a person has all travel documents required to enter a country.
5.5. The citizens of the Republic of Latvia can obtain detailed information about the travel documents and conditions on which they can enter foreign countries from the website of the Ministry of Foreign Affairs at http://www.am.gov.lv.
5.6. Passengers must prove possession of valid vaccination certificate to enter certain countries. Information about the regions of high risk contagious diseases and vaccination recommendations are available at the websites https://reopen.europa.eu/lv/ and https://travelvitals.amexgbt.com/ .

6. Liability and the applicable legislation

6.1. Estravel Latvia is liable for organisation of sale and the sale itself of the Travel Services, as well as forwarding the Service Provider’s information to the Client.
6.2. Estravel Latvia is not liable for execution of obligations under the contract made between the Client and the Service Provider, form the Service Provider’s part, including but not limited to the content and validity of the sale promises made by the Service Provider. Estravel Latvia is also not liable if the Service Provider withdraws from its sale promises or changes the price or terms and conditions of the Travel Service at any time. Estravel Latvia is also not liable if the Service Provider decides to suspend or terminate sales and/or the provision of Travel Services without a notice.
6.3. The relations between the Client and Estravel Latvia are regulated by the agreement and the legislation of the Republic of Latvia. The disputes that may arise between the parties shall be addressed to the Consumer Rights Protection Centre.
6.4. The legal relations between the Client and the Service Provider are regulated by: legislation of the country that regulates the Service Provider’s actions; the international law - in case of providing transnational services.

7. Complaints

7.1. Estravel Latvia must be immediately informed of any questions or problems related to the Travel Services before the Travel Service has started. If, at the time of travelling, the Client establishes that the Travel Service does not comply with the contract, he/she must immediately inform the local Service Provider about it.
If no solution is found on the spot, a written complaint must be filled-in as soon as possible, but at the latest in 7 (seven) days after the end of the trip or the provision of the purchased Travel Service, and at the latest in 2 (two) weeks after he/she has becoming aware of the problem. Complaints submitted after the said deadline periods shall be deemed as expired.

You need JavaScript enabled to view it.. Evidences of the breach of contract and documents that prove extra costs and caused damages must be enclosed with the message.
7.2. Any disputes will be resolved in the way of negotiations. In case of failing of reach agreement, disputes will be resolved by the Consumer Rights Protection Centre, at Str. Brivibas 55, Riga, LV-1010.

8. Personal data protection strategy

8.1. Estravel Latvia’s data protection strategy refers to the commitment of the Authorized Processor to treat the personal data of employees, customers, stakeholders and other interested parties with extreme diligence and to rely on existing data protection standards to process their data. By this policy we ensure that we collect, store and process data in a fair and transparent manner, respecting the individual rights of persons.
8.2. The strategy establishes general basis for processing of the personal data by Estravel Latvia.
8.3. We monitor that our activities are appropriate and legally upgraded by awareness of the workforce, and technically - by monitoring the conformity of our hardware and software with technical progress on a daily basis.
8.4. Estravel Latvia is committed ensuring that the data subjects control their data processing as much as possible and establishes a user-friendly regulation for the data subject.
8.5. The strategy is specified by the Privacy Statement, which is available on Estravel Latvia’s website at https://www.estravel.lv/lv/privatuma-politika/.
8.6. Consent to process the personal data

8.6.1. By submitting an order, a person gives Estravel Latvia - Estravel AS branch in Latvia, uniform reg. No LV40003318736, legal and actual address at Str. The Consumer agrees to transfer the personal data, incl. to third parties, considering the regulations stated under Personal Data Processing Law. The Client is aware of his/her rights to receive information about collected personal data, use of these personal data and persons the data was transferred to at any time; to request the correction of inaccurate data; to terminate data processing and to the data if such activities do not contradict the law.
